Toye focuses on issues relating to substantive justice as mediated through the international trade regime. He argues that the transition from the GATT to the WTO is leading to the continuation, possibly even the worsening, of inequality amongst countries. Toye concludes that formal justice is at odds with substantive justice since the inequalities of political and economic power between developed and developing countries have not been compensated for in the enactment of supposedly improved trade procedural rules.Less

Korea has pursued a policy of negotiating FTAs with key partners since it adopted the FTA Policy Roadmap in 2003. The EU-Korea FTA is therefore one of several instruments negotiated by Korea in the last decade. This chapter provides an overview of Korea’s policy and institutional framework for the negotiation of FTAs, including recent reforms introduced in response to the controversy caused by the adoption of the Korea-United States FTA. The chapter critically analyses the content of the Korea Trade Procedure Act of 2012 and how this legislation seeks to ensure greater transparency in the procedures for the ratification of FTAs. The author argues that in order to guarantee the stable operation of FTAs, it is necessary to promote public participation in relation to the ongoing implementation of FTAs. Thus, it is suggested that the Korean government should seriously consider the creation of an institutional link between the international bodies responsible for overseeing the FTA and the national procedures that promote public participation in trade and economic affairs.Less
