Drawing on philosophical accounts of identity and individuality, as well as the histories of both classical and quantum physics, this book explores two alternative metaphysical approaches to quantum particles. It asks if quantum particles can be regarded as individuals, just like books, tables, and people. Taking the first approach, the book argues that if quantum particles are regarded as individuals, then Leibniz’s famous Principle of the Identity of Indiscernibles is in fact violated. Recent discussions of this conclusion are analysed in detail and the costs involved in saving the Principle are carefully considered. For the second approach, the book considers recent work in non-standard logic and set theory to indicate how we can make sense of the idea that objects can be non-individuals. The concluding chapter suggests how these results might then be extended to quantum field theory.Less

The globalization of financial markets has contributed to a growing consensus that national financial reporting standards should give way to a single, harmonized set of global reporting standards. This book takes a more practical approach and reaches a different conclusion: that global standards are unlikely to be achieved, and in any event, are not likely to remain unified in the face of continued changes in markets and financial practices. National accounting standards are likely to continue to be relevant for the foreseeable future, and for that reason, the book discusses the national systems and their origins in some detail. The authors also consider a range of other substantive reporting issues, notably the debate over the issue of “fair value” measurement of assets and liabilities, which the authors reject in favor of a system that marks to market only those assets with deep traded markets, coupled with additional disclosures, where relevant.Less

This product liability case brought against a company that produced a ship cleaning product centered on the warning label for the cleaning product, which had caused a worker's brain damage. Comparison was made between the industry safety standards for the precautionary labeling of industrial chemicals and the text on the cleaning product's container. The wording of the warning section on the container was not prominent to the potential danger of the product. The communication of the dangers that users might encounter were unclear, and the advice about what to do if users got into trouble using it were not conveyed explicitly. The discourse sequencing within the warnings placed the least crucial information before the most crucial and provided no information about what to do to avoid the hazards that the product contained. The plaintiff also rewrote the text of the container to show how it could have been user-friendly and to communicate useful information and prevent further harm.Less

This book analyses the normative framework underlying the statebuilding activities of the international administrations in Bosnia and Herzegovina, Kosovo, and East Timor. It argues that a particular understanding of sovereignty has shaped the efforts of these international administrations, and examines the influence of this conception on three aspects of statebuilding: institution-building, the behaviour of international institutions towards local actors, and the timing and nature of the transition from international to local authority — the exit strategies of international administrations. The book argues that international administrations hold a conception of ‘sovereignty as responsibility’: states have to fulfil a set of responsibilities towards their population, in particular administrative effectiveness, the protection of human rights, democracy, the rule of law, and maintaining a free market economy. These responsibilities constitute a ‘standard of civilisation’, which legitimises sovereign authority, and failure to fulfil this standard can lead to international intervention and the denial of sovereign rights. The book shows how this ‘standard of civilisation’ is used by international administrations both to justify the denial of self-governance, and to serve as a blueprint for their institution-building activities. The restructuring of political and administrative practices to help post-conflict territories to meet this standard creates a sovereignty paradox: international administrations compromise one element of sovereignty — the right to self-government — in order to implement domestic reforms to legitimize the authority of local political institutions, and thus strengthen their sovereignty. In the light of the governance and development record of the three international administrations, the book assesses the promises and the pathologies of statebuilding, and develops recommendations to improve their performance.Less

It was possible that the inequality stemmed from the fact that D. B. had undergone right cervical sympathectomy prior to his brain surgery, resulting in a constricted pupil in his right eye. The two eyes were compared when the vision of each was restricted by an artificial pupil of 4 mm aperture. With the artificial pupil, the difference between the eyes was no longer significant.Less

Self-appointed experts, consultants, and organizations try to convince states, corporations, and individuals that they would be better off if they only followed some specific rules about what to do. These rules are presented as being voluntary and advisory. They are standards, not mandatory directives, and they abound in modern life. Standards may concern what characteristics a telephone should have, how a company should report its financial transactions, how organizations should be managed, how states should treat their citizens, how children should be raised, and so forth. Even organizations as powerful as states and large corporations follow standards on how to organize, which policies to pursue, what kinds of services to provide, or how their products should be designed. Standards enable a higher degree of global order in the modern world than would exist without them. They facilitate coordination and cooperation even among people and organizations that are far apart. The book states that standardization is a much neglected area of social science — an area that has by no means received the attention it deserves in view of its importance to society. This book redresses the balance by providing an in-depth examination of a number of aspects of standardization, how it is formed, and what effects it has on the world in which we live.Less

It replies to this question through the identification of corporate accountability standards and their implementation by international organizations. The book examines systematically all international sources of corporate accountability standards in the specific area of environmental protection and elaborates on their theoretical and practical implications for international environmental law. The book argues that although international environmental treaties do not bind multinational corporations and other business entities, growing international practice points to the emergence of legal standards that allow adapting and translating inter-State obligations embodied in international environmental law into specific normative benchmarks to determine the legitimacy of the conduct of the private sector against internationally recognized values and rules. The book also focuses on the role of international organizations in selecting international environmental standards and promote their application to business entities, in the absence of State intervention. The book analyses the growing practice of international organizations, which are driving a process of emergence of international standards for corporate environmental accountability. Furthermore, the impact of international organizations' direct relations with the private sector is also assessed, as it significantly contributes to ensuring that private companies comply with international environmental standards.Less

This chapter evaluates the effect of globalization on the extent of a country’s labor regulation and the influence of national and international labor regulations on labor conditions. There is no evidence of an international race to the bottom in labor regulation. Other things considered equally, neither the size of a country's trade sector nor its trade policy appears to influence the extent of labor protection afforded by national labor legislation. The evidence also indicates that the system of international labor standards regulation administered by the International Labor Organization has not significantly improved labor conditions. Countries tend to ratify ILO labor standards that their domestic regulations already satisfy, rather than incurring the political costs of introducing or altering national legislation to meet higher standards. National labor regulations rarely benefit workers generally; instead some groups of workers gain at the expense of other workers.Less

In a non-technical language, the book provides an overview of the history of ratings, the role of rating agencies, the industry, the uses of ratings and the rating process. The US subprime crisis that highlighted relevant deficiencies in the rating agencies’ activities and their systemic relevance, led to an international consensus to establish public oversight and regulation of the rating business. The book explains the global initiatives undertaken by the G-20, the Financial Stability Board, and IOSCO to address those failures and the European implementation of such a consensus. It also provides an overview of the new European System of Financial Supervisors implemented as a reaction to the crisis and examines the supervisory and enforcement powers of ESMA, the new authority in charge of the registration and oversight of rating agencies. Through an in-depth analysis of the European Regulation’s requirements on governance, conflicts of interest, methodologies, disclosures, and transparency, the book provides a clear explanation of how rating agencies operate and how the identified failures have been addressed. The explanation of all these aspects is complemented with an analysis of guidance from supervisors (ESMA and EBA), IOSCO’s recommendations, and US legislation. Finally, the book discusses possible new regulatory developments in areas such as the agencies’ business model, competition, civil liability, and ratings of sovereign debt. It concludes with the authors’ support for an enhanced regulatory and oversight coordination at global level, a reduction of the existing over-reliance on ratings, and a concentration of resources on the enforcement of the current regulatory regime.Less

This book explains how the three main mechanisms of globalization — international trade, international migration, and international capital flows — alter working conditions (particularly wages, work hours, and job safety) and labor rights (freedom of association, nondiscrimination, and the elimination of forced and child labor). An important sub-theme is the relative importance of international markets and international regulation in providing improvements in labor conditions around the world. The book presents evidence on how labor conditions changed during the late 20th-century globalization, and on how economic growth, international trade, migration, and multinational companies influence labor conditions around the world. Drawing on analyses of an international database on labor conditions prepared for this study and on numerous research studies, the book finds a general improvement in labor conditions during the late 20th century and documents the positive influence of economic development on those conditions. Chapters on the role of trade, migration, and multinational companies find that each mechanism of globalization is associated with the improvements in working conditions and with improvements in most labor rights. In contrast, the evidence does not support the view that increasing economic integration initiates an international race to the bottom that produces sweatshop labor conditions. The book also considers the influence of national and international labor regulations on working conditions and labor rights around the world. The evidence indicates that in contrast with trade, migration, and international capital flows, labor standards regulation has had a limited role in advancing labor conditions. Provides a detailed overview of the setting of European standards, focusing on the histories, organizational structures, and operating environments of the private standards‐setting bodies that have been given an increased role in negotiating rules for the single market. An analysis of these bodies (CEN, CENELEC, and ETSI) provides an important assessment of the new institutional framework created to govern markets. Given the importance of this new approach, this chapter provides an in‐depth insight into the reorganization of responsibilities and roles of the various public and private actors in managing regulatory policy in the single market. The standards‐setting process is complex, and the organizational culture and operating norms of the standards bodies are reviewed to illustrate the dynamics of cooperation and the cooperation required to reach a coordinated solution. Dealing with collective action problems due to differing interests and regulatory traditions, the chapter demonstrates the importance of problem solving, alliance formation, and strategic bargaining as well as the role of mutual trust, credibility, and reputation in achieving some form of agreement on European standards.Less
