This book examines the process through which a World Trade Organization (WTO) dispute settlement panel formulates its conclusions with respect to the facts of a case, i.e., the process of fact-finding or process of proof. The Dispute Settlement Understanding provides general guidance but few direct answers to specific questions regarding the process of fact-finding, which has placed upon panels and the Appellate Body the responsibility to provide answers to those questions as they have arisen in the cases. This book reviews the extensive jurisprudence developed in the 14 years of operation of the WTO dispute settlement system with a view to (a) determining whether panels and the Appellate Body have set out optimal rules to govern the process of fact-finding and, to the extent that that is not the case; and (b) to make suggestions for improvement. This book analyses questions such as: (i) Which party bears the responsibility of ultimately convincing the panel of the truth of a fact (burden of proof)?; (ii) What quantum of proof is necessary to convince the panel (standard of proof)?; (iii) The role of the panel, disputing parties, and non-disputing parties (e.g,. experts, international organizations, private parties) in the development of the evidentiary record on which the panel bases its decision; (iv) The consequences of a party's failure to cooperate in the process of fact-finding; (v) How the parties can access the information which is necessary to prove their allegations; and (vi) The treatment of confidential business and governmental information. In assessing and making suggestions to improve the answers provided by panels to these questions, the book draws on the approaches followed in the two major legal systems of the world — the common law and the civil law — and to the extent possible, the approaches adopted by other international courts and tribunals.Less

Each essay in the volume provides historical, literary, and philosophical commentary on a particular Zen text or genre of texts. Among the most prominent types of texts featured are Chan or Zen “recorded sayings” (yulu) texts, “transmission of the lamp” anthology texts (chuandenglu), koan collections, and “rules of purity” or monastic regulation texts. These canonical writings helped shape the overall conception of Zen Buddhism and the kinds of practices that have come to give Zen its identity. One theme of Zen Canon, therefore, is that the classical anti-textual posture of Zen Buddhism is not one that can be taken literally. While making fun of spiritual writing of all kinds, Zen Buddhists managed to produce one of the largest and most influential bodies of canonical texts in the world. There are over a million jazz recordings, but only a few hundred tunes have been recorded repeatedly. Why did a minority of songs become jazz standards? Why do some songs—and not others—get re-recorded by many musicians? This book answers this question and more, exploring the underappreciated yet crucial roles played by initial production and markets—in particular, organizations and geography—in the development of early twentieth-century jazz. The book considers why places like New York played more important roles as engines of diffusion than as the sources of standards. It demonstrates why and when certain geographical references in tune and group titles were considered more desirable. It also explains why a place like Berlin, which produced jazz abundantly from the 1920s to early 1930s, is now on jazz's historical sidelines. The book shows the key influences of firms in the recording industry, including how record labels and their executives affected what music was recorded, and why major companies would re-release recordings under artistic pseudonyms. It indicates how a recording's appeal was related to the narrative around its creation, and how the identities of its firm and musicians influenced the tune's long-run popularity. Applying fascinating ideas about market emergence to a music's commercialization, the book offers a unique look at the origins of a groundbreaking art form.Less

Systemic interactions in brain networks have been successfully studied in vivo using non-invasive methods such as electroencephalography (EEG) and functional magnetic resonance imaging (fMRI), for many years. The rate-limiting step, however, is that each method can only map selective aspects of brain function, while missing other key aspects. Furthermore, the inferences on neuronal processes and information flow are often rather indirect. By simultaneously combining both methods, the researcher is better able to make optimal use of their specific advantages while compensating for their disadvantages. In recent years, research has shifted and expanded, from demonstrating technical feasibility, to methodological issues of artifact control, new ways of analyzing and integrating data, and to applications for scientific and clinical questions. Combined EEG and fMRI methods now cover everything from physiological questions on the bases of the two recorded signals, to more specific questions on the mechanisms of certain cognitive and pathological functions like epileptic brain activity. Simultaneous EEG and fMRI provides the interested researcher with the tools to establish a simultaneous EEG-fMRI laboratory, as well as for those scientists who are interested in integrating electrophysiological and hemodynamic data. As evidenced by the diversity of topics presented, this is a dynamically developing field in which several approaches are being tested, validated, and compared. Chapters are dedicated to the physiological bases of the measured signals, technical setup, sources of artifacts and data de-noising, various approaches of data analysis and fusion, as well as applications. In addition, open questions and directions for future research are outlined.Less

Electrons in solids behave like microscopic bar magnets, and in certain solids these align to produce macroscopic magnetizations. This book deals with the dynamics of this magnetization field. It addresses questions of microscopic mechanism only to the extent that residual interactions of the magnetic moments with other degrees of freedom of the host solid affect the dynamics, particularly the dissipative aspects. Several of these damping mechanisms are evaluated here for their effect on the equations of the magnetization dynamics. These dynamics are intrinsically nonlinear. This is important in the applications, particularly magnetic recording, which involves very large motion of the magnetization, well beyond the validity of linearized (small motion) approximations or limited extensions thereof. Therefore nonlinear solution methods are emphasized, but with only minimal use of numerical simulation.Less

This chapter examines the Chan or Zen text, the Lidai fabao ji, an important early text that was discovered in the Mogao caves of Dunhuang in 1900, and which had been lost for many years. Adamak finds that this text provides an important prototype of two genres, the “discourse records” (yulu) and the “transmission of the lamp records” (chuangdeng lu). This important early Zen text sheds light on the development of characteristically Zen genres in the Sung dynasty, and on the hagiographical styles that became central to the Chan tradition in that era.Less

This chapter reviews approaches to the empirical documentation of music as found in comparative musicology, folklore studies, and through the fifty-year history of ethnomusicology. Means of gathering and measuring research data are shown to be linked to available technology as well as to prevailing intellectual paradigms. The central part of the chapter focuses on empirical aspects of participant-observation, including the keeping of field notes, interviewing, photography, and audio- and video-recording. Good practice conventions for data preservation are explained and illustrated. The chapter's coda emphasizes the importance of ethics in research that documents the voices of live people.Less

This chapter discusses the role in the Chan tradition of Dongshan Liangjie (807–869, J. Tōzan Ryōkai), considered the founder of the Caodong lineage, one of the “five houses” of Chan, which became Sōtō Zen after being transmitted to Japan by Eihei Dōgen (1200–1253). In the crucial story of Dongshan’s parting with his teacher Yunyan Tansheng (781–841), Yunyan’s emblematic Dharma utterance, “Just this is it,” triggers Dongshan’s ensuing awakening while wading across a stream. This event and the verses by Dongshan provoked by it, present central themes for Dongshan’s career: the teaching of suchness, the praxis of mindful presence that engages it, and the subtlety of the dynamic relationship between student and teacher in this praxis. These themes remain pivotal in the Caodong/Sōtō lineage even to its modern expressions.Less
