This book defends a particular liberal conception of justice and legitimacy, and applies it to certain issues concerning the upbringing of children. It begins by offering an account of liberal political morality that draws on the work of Rawls and Dworkin. It then defends the claim that the distribution of childrearing rights should be sensitive to the interests of both children and parents. With respect to the issue of whether it is permissible to impart controversial values to children, a distinction is drawn between shaping children’s political motivations and enrolling them into disputed conceptions of the good. Whereas there is a requirement of liberal legitimacy to foster liberal virtues of civility and reciprocity, the widely held view that the enrolment of children into particular ethical or religious practices is rejected as illegitimate. Finally, the practice of age-based discrimination in the case of the allocation of certain rights, such as the right to vote, is defended and criteria for determining the appropriate age of majority are discussed.Less

The conventional view of international society has it that it is interested only in co-existence and order amongst states. This creates a puzzle. When the historical record is examined, we discover that international society has repeatedly signed up to normative principles that go well beyond this purpose. When it has done so, it has built new normative constraints into international legitimacy, and this is most conspicuously so when it has espoused broadly humanitarian principles. This suggests that the norms adopted by international society might have been encouraged from the distinct constituency of world society. The book traces a series of historical case studies which issued in international affirmation of such principles: slave-trade abolition in 1815; the public conscience in 1899; social justice (but not racial equality) in 1919; human rights in 1945; and democracy as the only acceptable form of state in 1990. In each case, evidence is presented of world-society actors (transnational movements, advocacy networks, and INGOs) making the political running for a new principle, often in alliance with a leading state. At the same time, world society has mounted a normative case, and this can be seen as a degree of normative integration between international and world society. Collectively, the book contributes to the growing IR literature on the role of norms, and especially that written from a broadly English School or constructivist perspective.Less

The European Union is frequently accused of having a ‘democratic deficit’. Many commentators argue that this could be remedied by increasing the powers of the European Parliament relative to those of the Council and the Commission. The fact that the European Parliament is the only EU institution whose members are directly elected leads to the assumption that it is also the most legitimate. This book argues that this position is based on the flawed assumption that the nature of European citizenry is similar to those of the member states. In other words, the position assumes that the union has a demos, or a people, who are prepared to accept majority outcomes even when finding themselves in the minority. The book argues that this is not the case and that the most severe dimension of the democracy problem is not procedural, but socio-psychological. The fact that the EU does not have a people means that establishing an EU-wide democracy based on analogies to domestic political systems is likely to lead to a further loss of democratic legitimacy. The EU can rely on output legitimacy in policy areas which do not require pan-European solidarity and identity, and in which policy-making at EU-level increases efficiency and thereby benefits all citizens. However, policy areas which require high levels of solidarity or a common identity should either remain fully within the nation states, or be subject to intergovernmental rather than supranational decision-making at EU-level.Less

A pressing question at the forefront of current global political debates is: how can we salvage the democratic project in the context of globalization? In recent years, political activists have mounted high-profile campaigns for the democratization of powerful international institutions such as the World Bank and IMF, and for greater ‘corporate accountability’. In turn, many of the NGOs linked to these campaigns have themselves faced demands for greater democratic legitimacy. Through reflecting on the democratic dilemmas surrounding the political power of global NGOs, this book challenges the state-centric theoretical assumptions that have underpinned the established democratic theories of both ‘cosmopolitan’ and ‘communitarian’ liberals. In particular, it challenges the widespread assumption that ‘sovereign’ power, ‘bounded’ (national or global) societies, and ‘electoral’ processes are essential institutional foundations of a democratic system. The book then re-thinks the democratic project from its conceptual foundations, posing a number of questions. What needs to be controlled? Who ought to control it? How could they do so? In answering these questions, the book develops a theoretical model of representative democracy that is focused on plural (state and non-state) actors rather than on unitary state structures. It elaborates a democratic framework based on the new theoretical concepts of public power, stakeholder communities, and non-electoral representation, and illustrates the practical implications of these proposals for projects of global institutional reform.Less

The essence of this turn is that democratic legitimacy is to be found in authentic deliberation among those affected by a collective decision. While the deliberative turn was initially a challenge to established institutions and models of democracy, it was soon assimilated by these same institutions and models. Drawing a distinction between liberal constitutionalism and discursive democracy, the author criticizes the former and advocates the latter. He argues that a defensible theory of democracy should be critical of established power, pluralistic, reflexive in questioning established traditions, transnational in its capacity to extend across state boundaries, ecological, and dynamic in its openness to changing constraints upon, and opportunities for, democratization.Less

The Kosovo Report is a final product of the work by the Independent International Commission on Kosovo, established to examine key developments prior to, during, and after the Kosovo war, including systematic violations of human rights in the region. The report assesses effectiveness of diplomatic efforts to prevent the war, legality of the NATO bombing campaign against Yugoslavia, and the progress of the United Nations in post‐conflict reconstruction. The Report makes a recommendation for the future status of Kosovo and proposes a new general framework for humanitarian intervention based on principles of legitimacy. It argues that the intervention by the international community in the Kosovo conflict did not so much create a precedent for intervention elsewhere as raise vital question about the legitimacy and practicability of the use of military force to defend human rights. The intervention, the Report concludes, exposed the limitations of the current international law on the balance between the rights of citizens and the rights of states; it demonstrated the difficulties that ensue when even the most sophisticated and professional military forces are deployed to achieve humanitarian goals; and it showed the immense obstacles that lie in the path of creating multi‐ethnic cooperation in societies torn apart by ethnic war.Less

The sister volume to a book called Political Parties in Advanced Industrial Democracies, this book offers a systematic and rigorous analysis of parties in some of the world's major new democracies. Drawing on a wealth of expertise and data, the book assesses the popular legitimacy, organizational development and functional performance of political parties in Latin America and postcommunist Eastern Europe. It demonstrates the generational differences between parties in the old and new democracies, and reveals contrasts among the latter. Parties are shown to be at their most feeble in those recently transitional democracies characterized by personalistic, candidate-centred forms of politics, but in other new democracies — especially those with parliamentary systems — parties are more stable and institutionalized, enabling them to facilitate a meaningful degree of popular choice and control. Wherever party politics is weakly institutionalized, political inequality tends to be greater, commitment to pluralism less certain, clientelism and corruption more pronounced, and populist demagoguery a greater temptation. Without party, democracy's hold is more tenuous.Less

This book examines the dynamics between informal groups of states and the UN Security Council in the management of conflicts in Namibia, El Salvador, and Kosovo. It sets forth three main arguments. Firstly, that informal groups of states are agents of incremental change. They proliferated in the 1990s out of the increasing demands on the United Nations to adapt to the new security environment of the post-bipolar world, without formally changing the constitutional foundation of the Organization. Secondly, that informal mechanisms may narrow the operational and participatory gap growing out of the multiple incapacities that prevent the Security Council from formulating an effective response to crisis situations. Informal groups of states may enhance Council governance if they strike a balance between competing demands of inclusiveness, efficiency, informality, transparency, and accountability. Thirdly, that the post-Cold War era has fostered an environment where the substance of conflict resolution and the process of its legitimation have become increasingly detached. The former tends to be delegated to informal groups or coalition of states, while the Security Council provides the latter. The successful merger of right process and substantive outcome may strengthen the legitimacy of the Council and make actions taken by informal settings more acceptable.Less

A growing number of political philosophers favour a view called liberal perfectionism. According to this view, liberal political morality is characterized by a commitment to helping individuals lead autonomous lives and making other valuable choices. This book rejects this widely held view and offers an alternative account of liberal political morality. It argues that the liberal state should not be engaged in determining what constitutes a valuable or worthwhile life nor try to make sure that individuals live up to this ideal. Instead, it should remain neutral on the issue of the good life, and restrict itself to establishing the fair terms within which individuals can pursue their own beliefs about what gives value to their lives. The book thus defends a position known as political liberalism. The first part of the book subjects the liberal perfectionist position to critical scrutiny, advancing three major objections which raise serious doubts about the liberal perfectionist position with regard to autonomy, paternalism, and political legitimacy. The second part of the book presents and defends a distinctive version of political liberalism. In particular, it clarifies and develops political liberalism's central thesis: that political principles, in order to be legitimate, must be publicly justifiable to reasonable people. Drawing on the work of John Rawls, the author offers his own interpretation of this idea, and rebuts some of the main objections that have been pressed against it. Deliberative democracy now dominates the theory, reform, and study of democracy. Working at its cutting edges, this book reaches from conceptual underpinnings to the key challenges faced in applications to ever-increasing ranges of problems and issues. Following a survey of the life and times of deliberative democracy, the turns it has taken, and the logic of deliberative systems, contentious foundational issues receive attention. How can deliberative legitimacy be achieved in large-scale societies where face-to-face deliberation is implausible? What can and should representation mean in such systems? What kinds of communication should be valued, and why? How can competing appeals of pluralism and consensus in democratic politics be reconciled? New concepts are developed along the way: discursive legitimacy, discursive representation, systemic tests for rhetoric in democratic communication, and several forms of meta-consensus. Particular forums (be they legislative assemblies or designed mini-publics) have an important place in deliberative democracy, but more important are macro-level deliberative systems that encompass the engagement of discourses in the public sphere, as well as formal and informal institutions of governance. Deliberative democracy can be applied fruitfully in areas previously off-limits to democratic theory: networked governance, the democratization of authoritarian states, and global democracy, as well as in new ways to invigorate citizen participation. In these areas and more, deliberative democracy outperforms its competitors.Less
Deliberative democracy now dominates the theory, reform, and study of democracy. Working at its cutting edges, this book reaches from conceptual underpinnings to the key challenges faced in applications to ever-increasing ranges of problems and issues. Following a survey of the life and times of deliberative democracy, the turns it has taken, and the logic of deliberative systems, contentious foundational issues receive attention. How can deliberative legitimacy be achieved in large-scale societies where face-to-face deliberation is implausible? What can and should representation mean in such systems? What kinds of communication should be valued, and why? How can competing appeals of pluralism and consensus in democratic politics be reconciled? New concepts are developed along the way: discursive legitimacy, discursive representation, systemic tests for rhetoric in democratic communication, and several forms of meta-consensus. This chapter illustrates the extreme case of conducting crisis management outside the UN framework without explicit authorization of the Security Council. It argues that despite the marginalization of the Security Council in the management of the crisis, the institution continued to exert a pull on the players to seek post-hoc legitimization of the settlement. The prospect of re-involving the United Nations constituted an important precondition for the resolution of conflict. Ancillary to the first point, G-8 and Troika were instrumental in providing a platform for the re-involvement of the United Nations. Exiting the UN framework allowed the use of military force, which the Western Alliance considered necessary to achieve political outcomes. The retreat to informal settings such as Quint, G-8, and Troika allowed the merging of the military and political track of conflict management that had been disconnected.Less

This chapter deconstructs women’s words of connection to women, focusing on the connection women members of Congress feel towards other political women. Content analysis of transcripts shows that women members of Congress seem to conceptualize political women as a group with shared experiences and comradery, common concerns, and/or interrelated fates. However, the data also show that beneath the veneer of unity and connectedness revealed in women’s words is considerable complexity, driven not only by individual level forces — ideology, life experiences, race, etc. — but also shaped by the institutional environment of Congress and the constraints posed by its partisan structure.Less

When the 1994 elections gave control of Congress to a conservative, Christian Coalition-dominated, Republican majority, what some had over-optimistically touted as a critical mass of women became a token group, notwithstanding a slight increase in numbers. Nowhere was that more evident than in the ability of that new Republican majority to re-define the agenda, raising new issues (Partial Birth Abortion Ban) and challenging seemingly non-controversial, bipartisan, well-established programs (funding for the Title X Family Planning program and international family planning programs). The continued evidence of the gender gap in prochoice support, along with the critical role played by the shrinking cohort of prochoice Republican women in challenging their leadership’s anti-reproductive rights agenda, reinforce the importance of increasing descriptive representation. Nevertheless, the gendered roles assumed by a growing vocal cohort of female Republican reproductive rights opponents, reluctance by some ostensibly prochoice Republican women to challenge their leadership, a shrinking gender gap in prochoice support within Congress, and the frustrations of those who attempted to fight these often futile battles, all highlight the critical role that institutional environments, increased ideological diversity among women, and extra-institutional forces play in shaping the probabilistic relationship between descriptive and substantive representation, in strengthening or weakening perceptions of legitimacy surrounding gender difference, and in defining and redefining the meaning of substantive representation of women and realizing the potential for difference. These case studies explore gender differences in perspectives of reproductive rights opponents, provide insight into the value of bipartisan support for reproductive rights policy agendas (despite Republicans being less prochoice than Democrats), and point to the important role of women voters in maintaining bipartisan support and political resolve.Less

For centuries, France has struggled to impose unity upon its diverse components. Its leaders have defined its identity by opposition to the ‘Anglo-Saxons’: first England, then Britain and the USA. After exploring France's self-image by contrast with the Anglo-American counter-identity, Part One deals with the unfinished revolution from 1789 to 1878 when the Third Republic achieved relative stability. After examining the variety of symbolic representations of French exceptionalism in search of democratic legitimacy and national unanimity, the enduring divisions in French society are explained in their ideological, social, religious, territorial, and political aspects. Emphasis is given to writers and intellectuals in expressing these cleavages. Part Two relates French political paralysis to the slowness of socio-economic modernization and the polarizing role of intellectuals in perpetuating varieties of Left and Right battles over who personified anti-France. The adversarial character of French party politics fluctuated between the rhetorical revolutionary and reactionary extremes and the conservative or reformist realities. The colonial and international role of France is described, while the protectionist aversion to competitive global capitalism results in reluctant adaptation to forces beyond French control.Less

It is a ‘vulnerable’ legislature without a solid constituency of support, rendering its hard-won policy prerogatives subject to future challenges. Finally, it provides a way of making the concept of world society more accessible. The introduction poses the key puzzling question: why does international society buy into human rights norms in the first place? It sketches the outline answer that this occurs in response to both world society action and world society claims; there is simultaneously a political and a normative process at work.Less
