State capacity depends, most of all, of its democratic institutions. Only a strong and legitimate state will be able to provide good governance, individual and social justice, the guarantee of property rights and contracts, the protection to political and social rights, the defence of the national interests. An effective and efficient democratic state depends also on a good state organization and on competent government officials, able to make trade-offs between their legitimate personal objectives and the public interest. Public management reform is the contemporary form of assuring this kind state organization. In modern democracies, government officials–public managers as well as elected politicians–although also looking out for their own interests, are supposed to share republican virtues, to be committed to the general interest and to the protection of the public patrimony. Democratic institutions make them accountable for that.Less

Elections in Africa is the first volume of a series of election data handbooks published by OUP; it covers all the 53 states in Africa. Elections have always been an integral part of post‐independence African politics and have assumed the utmost importance in the course of recent democratization processes. However, comparative research on political development in Africa lacks reliable electoral data. Elections in Africa fills this gap. Following the overall structure of the series, an initial comparative introduction on elections and electoral systems is followed by chapters on each state of the region. These contributions examine the evolution of institutional and electoral arrangements from independence to the present (1999), and provide systematic surveys of the up‐to‐date electoral provisions and their historical development. Exhaustive statistics on national elections (presidential, parliamentary, and constitutional assembly), referendums and coups d’état are included within each chapter; these cover electoral bodies and voting, electoral participation of parties and alliances, vote distribution, parliamentary composition, and power holders. The data are presented in the same systematic manner for all countries in order to provide electoral statistics in line with internationally established standards of documentation, so that the data can be easily compared. The book, therefore, provides a definitive and comprehensive set of data on elections in order to facilitate comparative research. This study examines the impact of revolutionary states upon international society. These states have always posed major problems for the achievement of world order: revolution is often accompanied by international as well as civil conflict, while revolutionary doctrines have proven to be highly disruptive of the existing structure of international politics. Conversely, the prevailing international order presents fundamental difficulties for some revolutionary states. The belief system on which its revolution was founded and which legitimized the assumption of state power by the revolutionary elite is certain to run counter to the prevailing political doctrines of many other states. David Armstrong asks whether revolutionary states are ‘socialized’ into adopting acceptable patterns of international behaviour, or whether it is the international society that is forced to change when these new states appear. He looks in detail at the French, American, and Russian revolutions and at several post‐1945 revolutionary states. He also examines the relationship between revolutionary states and the principal ordering devices of an international society: international law, diplomacy, and the balance of power. His book is a significant contribution to the ‘English School’ literature, whose central concept is that of an international society. It shows how the interaction between revolutionary states and the established norms, rules, and institutions of international society works to produce change in both the revolutionary state and international society itself. Why does the regulation of risks to human health and safety vary so dramatically from one policy domain to another? Why are some risks regulated aggressively and others responded to only modestly? Is there any logic to the techniques we use in risk regulation? This book addresses these important questions by systematically examining variety amongst risk regulation regimes across policy domains, analysing the significant driving forces shaping those regimes, and identifying the causes of regulatory failure and success. In order to do so, the book develops a systems‐based concept of a ‘risk regulation regime’, which enables comparative description and analysis of the rules, institutional arrangements, and cultures that are bound up with the handling of risk within and between regimes. Using that framework, the book analyses how regimes and their constituent components are differentially shaped by three major driving forces—namely, the pressures exerted by market failure, by public opinion, and by organized interests inside and outside the state apparatus—and blame‐avoidance responses of regimes in the face of pressures for greater openness. The book applies the method to analyse a range of risk regulation regimes that cross the divide between ‘natural’ and ‘socially created’, state‐created and market‐created, ‘voluntary’ and ‘involuntary’, high‐tech and low‐tech, individually, and corporately produced risks. Those regimes include the release of paedophiles into the community, air pollution, local road safety, radon, pesticides, and dangerous dogs. The analysis reveals both variations and paradoxes that can neither be identified by single case studies, nor be easily explained by macro‐oriented approaches to understanding risk regulation. The Government of Risk shows how such an approach is of high policy relevance as well as of considerable theoretical importance.Less

One important concern is the nature of the utility function, how it is formed, and what is utility or happiness?[CE1]Social norms, cooperation models, game theory, behavioral economics, and neuroeconomics all have something to say about human behavior,and they also have important moral ramifications. While some claim that behavioral responses in these cases are merely self-interest disguised, outward behavior seems to work best in the long run if it is heartfelt. Character traits that signal trust are strongest when backed by moral commitments, and there is evidence that human brains are hardwired with some empathetic tendencies. The work of Dan Kahneman and AmartyaSen is highlighted in the closing vignettes.Less

Allocating reparation benefits to victims of civil rights abuses with a lasting effect on their well-being is a tremendous challenge. By converting benefit payments into shares and beneficiaries into shareholders of microfinance institutions (MFIs), the former victims become active partners of aid and owners of local institutions. In many countries, indigenous savings and credit associations are the only civil society institutions which have survived the breakdown of society, representing the social capital for the reconstruction of local financial institutions. In other countries, such institutions have to be newly built. In either case, experienced international NGOs may be instrumental in building or reconstructing MFIs owned by recipients of reparation payments. Part of the funding in a reparation program may thus be allocated directly to the victims-turned-shareholders, the other part to institution-building. Based on satisfactory performance of the MFI, the share capital may be augmented by donor grants and bank borrowings to increase the volume of loans to the user-owners for income-generating activities. In terms of sustainable impact, there is no alternative to institution-building.Less

‘Transparency’ is widely canvassed as a key to better governance, increasing trust in public-office holders. But it is more often preached than practised, more often referred to than defined, and more often advocated than critically analysed. This book exposes this doctrine to critical scrutiny from a range of disciplinary perspectives, including political science, philosophy, and economics. It traces the history of transparency as a doctrine of good governance and social organization, and identifies its different forms; assesses the benefits and drawbacks of measures to enhance various forms of transparency; and examines how institutions respond to measures intended to increase transparency, and with what consequences. Transparency is shown not to be a new doctrine. It can come into conflict with other doctrines of good governance, and there are some important exceptions to Jeremy Bentham's famous dictum that ‘the more closely we are watched, the better we behave’. Instead of heralding a new culture of openness in government, measures to improve transparency tend to lead to tighter and more centralized management of information.Less

While admirably adapted to explaining the unitary law-state, they are poorly suited to characterizing new law-like phenomena. From international law to the new legal order of the European Union, to shared governance and overlapping jurisdiction in transboundary areas, what at least appear to be instances of legality are at best weakly explained by approaches that presume the centrality of legal system as the mark and measure of social situations fully worthy of the title of legality. What next, as phenomena threaten to outstrip theory? Legality's Borders: An Essay in General Jurisprudence explains the rudiments of an inter-institutional theory of law, a theory which finds legality in the interaction between legal institutions, whose legality is characterized in terms of the kinds of norms they use rather than their content or system-membership. Prominent forms of legality such as the law-state and international law are then explained as particular forms of complex agglomeration of legal institutions, varying in form and complexity rather than sheer legality. This approach enables a fundamental shift in approach to the problems of identity and continuity of characteristically legal situations in social life: once legality is decoupled from legal system, the patterns of intense mutual reference amongst the legal institutions of the law-state can be seen as one justifiably prominent form of legality amongst others including overlapping forms of legality such as the European Union.Less

Democracy was inspired by the lofty ideals of the French Revolution: liberty, equality, and fraternity. These ideals led many countries to challenge the absolutist monarchies of the past. In Europe, democratic ideals and values grew in response to the oppressive rule of absolutist monarchs. In India, the idea of democracy came with colonial rule but conferred subjecthood without citizenship on the Indian people. Colonial rule kindled the aspiration of Indians to become a nation of free and equal citizens and led to the formation of a political party, the Indian National Congress. This book explores the political institutions of democracy in India, focusing on those that began to emerge from the middle of the nineteenth century onwards. It looks at Parliament and the state legislatures, the Supreme Court and high courts, and political parties, highlighting the maladies that beset these basic institutions of democracy today. After discussing the institutions of democracy, the book looks at the role of government and opposition in a democracy, civil society and the state, constitutional morality, how institutions work and why they fail, the representation of India as a society of castes and communities as well as a nation of citizens, pluralism and liberalism in India, the distinction between law and custom, and the relationship between sociology and ideology.Less

It notes the difference in principle, since the primary goods measure of Rawls holds individuals responsible for their choices as to how to deploy these goods, whereas Cohen’s aim is to equalize access to advantage, and thereby the satisfaction of persons, however costly. It is argued that since Cohen concedes that practical matters of application might compromise egalitarian principle, the two thinkers might be, in practice, not that dissimilar.Less
