Consequentialists oppose while absolutists and deontologists rely upon double-effect reasoning (DER) to address hard cases in which good inextricably binds with evil (such as destroying a legitimate military target while concomitantly and foreseeably killing innocents). This book addresses the history, application, and philosophical controversy concerning DER. It traces both the origin of DER in the thought of Aquinas and its development by subsequent ethicists. Considering consequentialist criticisms, proportionalism, and recent revisions of double effect, the book argues at length for the reasonableness of DER, particularly the intended/foreseen distinction. Intent is distinguished from foresight, and this distinction is applied to the classic cases of terror and tactical bombing. Most importantly, the book establishes the ethical relevance of this distinction, grounding its import both in broadly Aristotelian-Thomistic features of action as voluntary, and in a Kantian focus on the victim as an end in himself. The book also considers typically neglected albeit intriguing issues such as DER’s application to allowings and how constitutional legal systems that incorporate exceptionless norms employ a legal analogue to DER.Less

This chapter examines the characteristics of infectious disease that raise special medical and social ethical issues, and explores ways of integrating both current bioethics and classical public health ethics concerns. Many of the ethical issues raised by infectious disease are related to these diseases' powerful ability to engender fear in individuals and panic in populations. The chapter addresses the association of some infectious diseases with high morbidity and mortality rates, the sense that infectious diseases are caused by invasion or attack on humans by foreign microorganisms, the acute onset and rapid course of many infectious diseases, and, in particular, the communicability of infectious diseases. The individual fear and community panic associated with infectious diseases often leads to rapid, emotionally driven decision-making about public health policies needed to protect the community that may be in conflict with current bioethical principles regarding the care of individual patients. The discussion includes recent examples where dialogue between public health practitioners and bioethicists has helped resolve ethical issues that require us to consider the infected patient as both a victim with individual needs and rights, and as a potential vector of disease that is of concern to the community.Less

This chapter presents the full exposition of the PVV view: that ethical problems in infectious disease should be analyzed, and clinical practices, research agendas, and public policies developed, which always take into account the possibility that a person with communicable infectious disease is both victim and vector. The PVV view works on three levels. First is ordinary life in which people are more or less aware of their actual circumstances of illness, health, and risk. Second is the population-wide view, in which patterns of disease, special risks for sub-populations, and progress or failure with respect to the overall burden of infectious disease can be observed. Third is the view of the “way-station self,” who is always in some sense at unknown and unknowable risk of disease. This third perspective is a naturalized version of the Rawlsian veil of ignorance: a thought-experiment that asks what choices and practices people would want with respect to infectious disease in light of the reality that they are always at unknown and unknowable risk of disease. These perspectives are difficult to hold in view at the same time, but each is essential to analysis of the ethical issues raised by infectious disease.Less

The ethical treatment of animals is one of serious academic interest today. Specifically, both the practice of animal experimentation and ethical concerns about it have a long history, going virtually back to the ancient Greek period and continuing to the present day. With new breakthroughs in science and technology, it is likely that this practice will be with us for a long time to come. Thus, this book provides an interdisciplinary approach to the topic by utilizing the insights of cognitive ethology, philosophy, science, and Christian theology in order to present a benign approach to the ethical treatment of experimental animals. The reality and existence of animal minds, animal pain, and animal suffering provide the foundation for animal rights, and subsequently, for more positive treatment. Concrete suggestions are offered with regard to more humane animal legislation, improved animal husbandry conditions, as well as concrete guidelines that offset the burdens to animals against the benefits to humans. The ultimate result is a more humane practice in experimentation, modeled somewhat on the practice of pet keeping, in which experimental animals are viewed not only as having instrumental value but intrinsic value as well.Less

This chapter emphasizes the originality of Jesus’ ethical teaching, obscured by the use of complex analytical terms (such as nonviolence, nonretaliation, compassion, kindness, tolerance, hypocrisy, anger, etc.) and brought to light by the use of more fine‐grained analytical tools such as GOOD and BAD KNOW, THINK, and WANT, and the other simple and universal human concepts. It shows that the apparent parallels in earlier religious lore – Jewish, Greco‐Roman, Hindu, Confucian, Buddhist, and so on – are often illusory and conceal profound conceptual differences. It argues that the vital matters of Christian‐Jewish dialogue are not well served by attempts to play down the distinctive features of Jesus’ teaching. It concurs with the fourth‐century Syrian biblical scholar, St. Efrem, who affirmed the “the smallest words of Christ contain immense treasures,” and it claims that the depth and originality of Jesus’ ethical teaching can be better revealed by means of simple and universal human concepts, than by the use of the technical language of traditional theology and exegesis.Less

This book looks at what enters into ethical judgment and choice. Interpretation of a case and of what the options are is always a factor, as is a sense of the possible values at stake. Intuitions also enter in, but often are unreliable. For a long time it seemed only fair that oldest sons inherited, and it struck few people as unfair that women were not allowed to attend universities. A moral judgment is putatively part of a moral order in a society that any reasonable person would accept. But what counts as “reasonable” is generally contestable. The unreliability of intuitions leads naturally to ethical theory. Kantian, contractualist, and consequentialist theories all have some important truth in them, but not the whole truth. Contractualism lacks the resources required for a fully determinate account of what counts as “reasonable.” Broad general rules are important to Kant and are at the center of everyday morality. But can Kantian ethics explain why they have to have this central role? Our evolving social contract now contains elements (e.g., the rejection of racism and sexism) that once would have seemed counter-intuitive to most people. But could consequentialists have predicted with entire confidence the consequences of social changes that we now think were desirable? The last part of this book contains a double argument. One is that ethical theory is employed by humans in a state of semi-ignorance of relevant factors, grasping at likely truths and evolved intuitions. The other is that consequentialist considerations have a major role at the fundamental level, but much more in justification or criticism than in ethical discovery.Less

In How Should Ethics Relate to (the rest of) Philosophy?, Stephen Darwall challenges both the claims of independence and priority. He argues that although metaethics and normative ethics are properly focused on different issues, they need to be brought into a dynamic relation with one another in order to produce a systematic and defensible philosophical ethics. Their mutual dependence, claims Darwall, is owing to the fact that issues of normativity are at the centre of the concerns of both metaethics and normative ethics. In making his case, Darwall examines Moore's doctrine that an irreducible notion of intrinsic value is fundamental in ethics, and argues that although Moore was correct in thinking that ethical notions are irreducible, he was incorrect in thinking that this is because they have a notion of intrinsic value at their core. Rather, according to Darwall, the notion of a normative reason is ethically fundamental, and a proper philosophical ethics that fully accommodates the normativity involved in ethical thought and discourse will require that metaethical issues and normative issues bearing on normativity be ‘pursued interdependently as complementary aspects of a comprehensive philosophical ethics’. He illustrates this claim by explaining how certain debates within normative ethics over consequentialism and over virtue depend upon metaethical issues about the nature of normativity.Less

Various themes of Williams's work are explored and taken in new directions. The chapters are all concerned with Williams's work on the viability or wisdom of systematic moral theory, and his criticism, in particular, of moral theory's preoccupation with impartiality. Some chapters address Williams's work on moral luck, and his insistence that moral appraisals bear a disquieting sensitivity to various kinds of luck. One chapter makes further connections between moral luck and the ‘non-identity problem’ in reproductive ethics. Other chapters investigate Williams's defence of ‘internalism’ about reasons for action, which makes our reasons for action a function of our desires, projects, and psychological dispositions. One chapter attempts to plug a gap in Williams's theory which is created by Williams's deference to imagination, while another chapter connects these issues to Williams's accommodation of ‘thick’ ethical concepts as a source of knowledge and action-guidingness. The book asks how, and how much, we can improve our ethical standards—not lift our behaviour closer to our standards but refine the standards themselves. To answer this question requires answering most of the major questions of ethics. So the book includes a discussion of what a good life is like, where the bounds of the natural world come, how values relate to that world (e.g. naturalism, realism), how great human capacities—the ones important to ethics—are, and where moral norms come from. Throughout the book, the question of what philosophy can contribute to ethics arises. Philosophical traditions, such as most forms of utilitarianism, deontology, and virtue ethics, are, the book contends, too ambitious. Ethics cannot be what philosophers in those traditions expect it to be because agents cannot be what these philosophies require them to be. The book starts by questioning the adequacy of both appeals to intuition and the coherence method of justification in ethics (e.g. wide reflective equilibrium) and ends with a description of the sort of justification available to us.Less

This is an innovative and original exploration of the connections between Sir Gawain and the Green Knight, one of the most well-known works of medieval English literature, and the tradition of French Arthurian romance, best-known through the works of Chretien de Troyes two centuries earlier. The book compares Gawain with a wide range of French Arthurian romances, exploring their recurrent structural patterns and motifs, their ethical orientation and the social context in which they were produced. It presents a wealth of new sources and analogues, which provide illuminating points of comparison for analysis of the self-consciousness with which the Gawain-poet handled the staple ingredients of Arthurian romance. Throughout, the author pays close attention to the ways in which the modes of representation of Arthurian romance are related to social and historical context. This chapter looks at a variety of ethnographic cases to show how recognition and intentionality are elaborated and brought into focus in different cultural contexts. It studies the concept of dewa, which seems to thematize the role that other people play in one's own sense of self. This concept, however, is not simply just one way of describing a universal feature of interaction. Once crystallized as an object of reflections, something that Sumbanese consciously know about the world and can connect to other things they know about their world, it also guides them as they purposefully undertake ethical actions. Indeed, the chapter argues that if recognition and intentionality are basic features of all social interaction anywhere, they also serve as affordances for dealing with, or reflecting on, particular ethical questions that concern a given community.Less

The strength of the rival view, ethical particularism, is that it connects people's duties to their identity, and thus better explains moral motivation. The content of national obligations is in itself somewhat indeterminate, but is given concrete form within the public culture of each nation, and in formal practices of reciprocity. Finally, ethical particularism is compatible with the recognition of universal human rights.Less

The Right and the Good is a classic of 20th‐century philosophy by the great scholar Sir David Ross, which is now presented in a new edition with a substantial introduction by Philip Stratton–Lake, a leading expert on Ross. Ross's book was originally published in 1930, and is the pinnacle of ethical intuitionism, which was the dominant moral theory in British philosophy for much of the 19th and early 20th century. The central concern of the book is with rightness and goodness, and their relation to one another. Ross argues against notable rival ethical theories. The right act, he holds, cannot be derived from the moral value of the motive from which it is done; furthermore, rightness is not wholly determined by the value of the consequences of one's action, whether this value is some benefit for the agent, or some agent‐neutral good. Rather, the right act is determined by a plurality of self‐evident prima facie duties. Ross portrayed rightness and goodness as simple non‐natural properties. Philip Stratton provides a substantial introduction to the book, in which he discusses its central themes and clears up some common misunderstandings. A new bibliography and index are also included, along with editorial notes that aim to clarify certain points and indicate where Ross later changed his mind on particular issues. This book is about the gap between the moral demand on us and our natural capacities to meet it. The author starts with Kant’s statement of the moral demand and his acknowledgement of this gap. He then analyses Kant’s use of the resources of the Christian tradition to make sense of this gap, especially the notions of revelation, providence, and God’s grace. Kant reflects the traditional way of making sense of this gap, which is to invoke God’s assistance in bridging it. The author goes on to examine various contemporary philosophers who do not use these resources. He considers three main strategies: exaggerating our natural capacities, diminishing the moral demand, and finding some naturalistic substitute for God’s assistance. He argues that these strategies do not work, and that we are therefore left with the gap and with the problem that it is unreasonable to demand of ourselves — a standard that we cannot reach. In the final section of the book, the author looks in more detail at the Christian doctrines of atonement, justification, and sanctification. He discusses Kierkegaard’s account of the relation between the ethical life and the Christian life, and ends by considering human forgiveness, and the ways in which God’s forgiveness is both like and unlike our forgiveness of each other.Less

Drawing lessons from the intersection of literature, photography, cinema, television, dance-drama, and ethnography, this book presents a unique analysis of Indian activist thought spread over two centuries. It discusses two presuppositions of liberal individualism: personal autonomy and ethical autonomy. Besides, it argues that the ‘individual’ has been creatively indigenized in modern non-Western cultures: thinkers attentive to gender in postcolonial cultures embrace selected ethical premises of the Enlightenment and its human rights discourse while they refuse possessive individualism. Debating influential schools of postcolonial and transnational studies, the chapter provides radical argument through a rich tapestry of gender portrayals drawn from two moments of modern Indian thought: the rise of humanism in the colony and the growth of new individualism in contemporary liberalized India. From autobiographical texts by nineteenth century Bengali prostitutes, point-of-view photography, as well as women-centred dance-dramas and essays by Rabindranath Tagore to representation of Tagore's works on mainstream television, video, and stage; feminist cinema, choreography and performance by Aparna Sen and Manjusri Chaki-Sircar respectively—the book makes use of such and much more to creatively engage with empire, media, and gender.Less
