The ‘self-image of the state’ in regard to political obligations is explored through examination of judicial decisions in three different democratic countries, while the book also breaks new ground by studying attitudes towards political obligations, through the use of small focus groups.Less

Tipping points are troublesome metaphors. They may be more the products of our own imagination than any possible reality. Confusion and uncertainty, together with the possible suddenness and catastrophe, make our imaginings even more lurid. We depend on models but more so because they are the only ones we use to predict. We may reach a state of justifiable alarm, but this is not a recipe for purposeful collective action. What is now required is a sense of common humanity which instils hope and courage and a sense that a better future is still within our grasp.Less

Antimicrobial resistance is growing at an alarming rate: reports of extensive multiple-drug resistant tuberculosis (XDR-TB and MDR-TB) and methicillin-resistant Staphylococcus aureus (MRSA) are but two of the most serious examples. Among the many causes of antibiotic resistance are overuse and a failure to complete courses of treatment. This chapter considers how patients, considering themselves as both potential victims and as potential vectors, might take risks of resistance into account in their decisions about treatment. Some analyses of antimicrobial resistance treat it as a tragedy of the commons: of rational individual decisions about use adding up to a catastrophe of overuse. This analysis is incomplete because it fails to take into account the interests of patients who might be victims in practices that continue to make antibiotics available to them. The chapter also suggests the possibility of a small surcharge on antibiotic use in the developing world, to be dedicated to research on new generation antimicrobials, as a reflection of this interest in continued available of therapies for dangerous pathogens.Less

George Berkeley notoriously claimed that his immaterialist metaphysics was not only consistent with common sense, but that it was also integral to its defense. This book argues that understanding the basic connection between Berkeley's philosophy and common sense requires a better understanding of the four principle components of Berkeley's positive metaphysics: the nature of being, the divine language thesis, the active/passive distinction, and the nature of spirits. This book begins by focusing on Berkeley's view of the nature of being. It elucidates Berkeley's view on Locke and the Cartesians, and examines Berkeley's views about related concepts such as unity and simplicity. From there, it moves on to Berkeley's philosophy of language, arguing that scrutiny of the famous Introduction to the Principles of Human Knowledge reveals that Berkeley identified the ideational theory of meaning and understanding as the root cause of some of the worst of humanity's intellectual errors, not abstract ideas. Abstract ideas are, rather, the most debilitating symptom of this underlying ailment. In place of the ideational theory, Berkeley defends a rudimentary use theory of meaning. This understanding of Berkeley's approach to semantics is then applied to the divine language thesis and is shown to have important consequences for Berkeley's pragmatic approach to the ontology of natural objects and for his approach to our knowledge of, and relation to, other minds, including God's. Turning next to Berkeley's much maligned account of spirits, the book defends the coherence of Berkeley's view of spirits by way of providing an interpretation of the active/passive distinction as marking a normative distinction and by focusing on the role that divine language plays in letting Berkeley identify the soul with the will. Arguments that ordinary inanimate objects such as tables and chairs, sticks and stones, simply do not exist have become increasingly common. Some arguments for eliminativism are based on demands for parsimony or for a non-arbitrary answer to the special composition question; others arise from prohibitions against causal redundancy, ontological vagueness, or colocation; and others still come from worries that a common sense ontology would be a rival to a scientific one. This book makes the case that the mistakes behind all of these superficially diverse eliminativist arguments may be traced to a common source, and may be successfully resisted by adopting a small cluster of interrelated and independently plausible theses about reference, analyticity, and modality. By adopting these theses, we can make sense of our common sense world view without internal contradiction, violation of plausible metaphysical principles, or rivalry with a scientific ontology. In the end, however, the most important result of addressing these eliminativist arguments is not merely avoiding their conclusions. It also leads to important metaontological results, bringing into question widely held assumptions about which uses of metaphysical principles are appropriate, which metaphysical demands are answerable, and how we incur ontological commitments. As a result, the work of this book hopes to provide not only the route to a reflective understanding of our unreflective common sense world view, but also a better understanding of the proper methods and limits of metaphysics.Less

It has often been claimed that the phrase ‘common sense’ occurs only three or four times in the Aristotelian corpus. However, the phrase ‘common sense’ can also be found in Historia Animalium I.3 489 a 17 and Metaphysics I.1 981 b 14. This chapter examines the two overlooked occurrences to see what the phrase ‘common sense’ means there. In the overlooked occurrences the phrase ‘common sense’ refers to the individual senses, to the sense of touch in particular, or to the five individual senses indiscriminately. There the phrase is not a proper name for any particular perceptual capacity, but rather a description applicable to the individual senses in certain contexts. Aristotle describes the individual senses as ‘common’ to bring out the fact that they are shared by animals of different species.Less

Nevertheless, there can be little doubt that, owing to Aristotle, it became a technical term at some point between Theophrastus and Alexander of Aphrodisias. There is consistency in Aristotle's use of the phrase ‘common sense’ which, on its own, would imply that the phrase is a technical term for Aristotle, functioning as a proper name for the sensory capacity of the soul. However, a survey of the other uses manifest variation which suggests that the phrase really did not have the status of a technical term for Aristotle. Depending on the context, the terms which make up the phrase can take different nuances in meaning within their respective semantic horizons and assume different word order to express different ideas. The four-volume series of which this book is the first volume shows how the legal systems of Britain's thirteen North American colonies, which were initially established in response to divergent political, economic, and religious initiatives, slowly converged until it became possible by the 1770s to imagine that all thirteen participated in a common American legal order, which diverged in its details but differed far more substantially from English common law. This book reveals how Virginians' zeal for profit led to the creation of a harsh legal order that efficiently squeezed payment out of debtors and labor out of servants. In comparison, Puritan law in early Massachusetts strove mainly to preserve the local autonomy and moral values of family-centered, subsistence farming communities. The law in the other New England colonies, although it was distinctive in some respects, gravitated toward the Massachusetts model, while Maryland's law, except during a brief interlude of Puritan rule, gravitated toward that of Virginia.Less

In this chapter, Said argues that in the case of the Palestinians and Israelis, histories and cultures are inextricably linked ‘contrapuntally’ in symbiotic rather than mutually exclusive terms. When this understanding of circumstances occurs, it no longer seems viable to eliminate the opposition because there will always be a tomorrow in which retribution will be demanded by those who feel that an injustice had been forced upon family members or previous generations. Said emphasizes the need to think about and resolve two histories that have become interwoven, despite the fact that many have tried to define the other in contradictory terms. Part of arriving at a Just Peace entails recognizing a shared identity and common history even if this approach highlights differences. This might be a monumental task considering the trials and tribulations that have often come to pass in a conflict, but for Said, an ‘abridged memory’ is not an option that will lead to Just Peace.Less

Is the point of belief and assertion invariably to think or say something true? Is the truth of a belief or assertion absolute, or is it only relative to human interests? Most philosophers think it incoherent to profess to believe something but not think it true, or to say that some of the things we believe are only relatively true. Common sense disagrees. It sees many opinions, such as those about matters of taste, as neither true nor false; it takes it as obvious that some of the truth is relative. This book argues that when it comes to truth, common sense is right, philosophical orthodoxy wrong. The first half of the book examines connections between the performative aspects of talk (what we do when we speak), our emotions and evaluations, and the conditions under which talk and thought qualifies as true or false. It argues that the performative and expressive sometimes trump the semantic, making truth and falsity the wrong dimension of evaluation for belief or assertion. Among the topics taken up are: racial slurs and other epithets; relations between logic and truth; the status of moral and ethical talk; vagueness, and the liar paradox. The book's second half defends the idea that much of everyday thought and talk is only relatively true or false. Truth is inevitably relative, given that we cannot work out in advance how our concepts will apply to the world. The book explains what it is for truth to be relative, rebuts standard objections to relativism, and argues that relativism is consistent with the idea that one view can be objectively better than another. The book is a comprehensive study of early Stoic political philosophy. It considers the conceptions of the cosmic city and the common law as central to the Stoics' theory, and discusses how these conceptions are integral to Stoic thought on reason, wisdom, and life in agreement with nature. Accordingly, the book devotes detailed attention to central areas of Stoic philosophy, such as the theory of affiliation (oikeiôsis), appropriate and perfect action, epistemology, and theology. The book discusses competing interpretations of Stoic cosmopolitanism, arguing that the ideal city of the early Stoics is the cosmos and thus is already in existence. All human beings live in the cosmic city, but only the wise and the gods are its citizens. The book devotes equal attention to the interpretation of the Stoics' conception of law. To live by the law, it is argued, is to live by nature, in a way which relies on understanding what is of value to human beings, rather than on following a set of rules. Against the view that early Stoic thought about these issues is best described as exploring an ideal for individual agents, the book argues that the Stoics are offering a theory which, while deeply connected with the core concerns of Stoic ethics, can be considered a genuine contribution to political philosophy.Less

This book is a distillation of a larger work Bennion on Statutory Interpretation. It consists of an introduction and eighteen chapters each summarized at the end. The common law system presented here is called the Global method both because it is worldwide and because it requires the interpreter to take every relevant consideration into account, including (under the doctrine of precedent) previous court decisions. The book starts by explaining what is meant by ‘common law legislation’. It then says that construing common law legislation has often been found difficult as an analytical concept, giving as the main reason deficiencies in legal education. One deficiency, still continuing, is to teach (mistakenly) that the interpretative criteria solely consist of the literal rule, the mischief rule, and the golden rule. The book aims to redress the deficiencies by presenting the issues briefly but correctly. There are a great many interpretative criteria, and where these conflict in a particular case there must be a judicial process of weighing and balancing. The criteria consist of four types: rules laid down by statute or common law, presumptions arising from the nature of legislation, principles of legal policy, and literary canons applying to all types of language. The book has a final chapter on techniques of ‘law handling’ or ‘law management’, which are central to any lawyer's or law student's functioning.Less

This book proposes that a casuistical free exercise analysis, while not perfect, protects the courts’ integrity by offering a fairer and more just process for resolving the conflict of principles that lies at the heart of free exercise cases. To those who would reject casuistry as a new element without precedent, and as an arbitrary choice without any foundation or authority, the book notes that casuistry is quintessentially the process used in common law decision making, and actually has been used in deciding a significant number of major free exercise cases by the U.S. Supreme Court. He is perennially successful, but perennially subject to critical controversy: do his plays aim to do more than make audiences laugh? This book focuses on a group of characters in the plays, the interpretation of whose role lies at the heart of any answer to this question. For over a century critics have called them raisonneurs. They are characters who engage with some of Molière's most foolish protagonists, but they have been variously interpreted as either exponents of wisdom or as bores who are subject to ridicule. This book argues that new light can be shed on the words and actions of these characters, and on the tenor of the plays as a whole by detailed contextual analysis of the structures of dramaturgy and comedy in which they are deployed. They emerge neither as the mouthpieces of common sense nor as pompous fools, but as thoughtful, witty, and resourceful friends of the foolish protagonists whom Molière himself played. The book takes into account what is known of the performance styles of Molière's troupe of actors as well as engaging closely with the text of the plays and the critical debate to date.
