This chapter provides a concise overview of the U.S. legal system, methods, and procedures as they might relate to the interests and duties of epidemiologic practitioners, whether they are based in local, state, or federal public health agencies, in academia, or in other settings. It examines U.S. law in relation to two areas of fundamental interest and importance to epidemiologists: the public health practice core applications of surveillance and outbreak investigations, and considerations for the epidemiologist as a potential expert witness or when she or he otherwise might become involved in related litigation. The chapter concludes by addressing the roles of epidemiology and the epidemiologist in lawmaking—specifically, in the processes of translating epidemiologic data into policy and law.Less

This chapter discusses the ways in which the U.S. government created an alternative archive when it recorded Mexicanas/os' voices in the "official" record during land grant adjudication proceedings in the mid- to late nineteenth century. The testimonio of landowner María Cleofas Bóne de López serves as a prime focus in the chapter to emphasize the ways in which marriage to Mexican women was one way that both Anglo and Mexican men gained access to and amassed material property. Through this and other key cases, the chapter emphasizes that males' land ownership was often predicated on relationships to and with Mexican women and the ways Mexican men were effeminized within the U.S. legal system. The depositions serve as testimonials to the integral role of gender in the history of property ownership and dispossession.Less

An attorney might conduct legal history research if the law at question in a legal dispute is very old: the U.S. Constitution and the Bill of Rights are well over two hundred years old. Historical research also comes into play when the question at issue is what the law was at a certain time in the past. Ultimately, law plays an important part in the political and social history of the United States. As such, researchers interested in almost every aspect of American life will have occasion to use legal materials. The chapter then describes the U.S. legal system and legal authority, and offers six points to consider in approaching a historical legal research project.Less

How should we conceptualize the relationships between conscious and nonconscious processing in some important decisions? This question is addressed in the context of an institutionally significant legal decision—the reasoning processes engaged in by American jurors when rendering verdicts in typical criminal and civil trials. A cognitive–psychological process model for the juror’s decision task is outlined and some of the behavioral evidence for the validity of that interpretation is presented. Thereafter, a discussion of the roles of conscious and nonconscious processes is provided within that framework.Less

This book is the first to focus on Indigenous women of the Southwest and Pacific Northwest and the ways they dealt with the challenges posed by the existing legal regimes of the nineteenth and twentieth centuries. In most western states, it was difficult if not impossible for Native women to inherit property, raise mixed-race children, or take legal action in the event of rape or abuse. Through the experiences of six Indigenous women who fought for personal autonomy and the rights of their tribes, the book explores a long yet generally unacknowledged tradition of active critique of the U.S. legal system by female Native Americans.Less
