This chapter focuses on the restricted character of international public policy and on the fact that though it belongs to each State, many of its fundamental principles are enshrined in human rights conventions and private international law conventions and therefore are shared by all the States Parties to that convention, which enables the integration and articulation of diversity, at either a regional or a universal level. Consequently, the identification of those shared fundamental principles should increase the predictability of results in private international law cases and soften the barrier that the public policy exception imposes regarding foreign laws and judgments. Notwithstanding this, the aforementioned statements do not mean that the role of the public policy exception will disappear. In order to develop this argument, this chapter explains some key concepts such as those of international and domestic public policy, a posteriori and a priori public policy, their differences and similarities. It examines how public policy evolves over time alongside society and how that evolution is reflected in statutory and conventional rules.Less

Amidst the growing enthusiasm for the application of behavioural insights from behavioural economics, psychology and the neurosciences in social policy, there has been a shift in emphasis from structural, through individuated and towards neuromolecular scales of explanation for social problems. This chapter explores the role of these trends in carving out new spatialities of social policy. The chapter considers the scale at which government intervention is deemed necessary, effective and efficient; and who should be responsible for health, productivity and wellbeing in liberal societies. It traces continuities between behavioural and neuroscientifically-informed public policy through analysis of international and supra-national policy documentation within societies in which neoliberalism is increasingly recognised as a source of social harm and economic instability. The chapter develops an approach to ‘critical neuro- geography’ which sheds new light on the strategic importance of scalar claims and other spatialities to forms of governance targeted at the mind, body and soul.Less

There are three main areas of focus: a) How we ‘do’ transport, as a result of available technologies and how we use them, b) How the ways in which we ‘do’ transport have certain consequences, across a wide range of policy areas, and c) How we could do things differently, to bring about different consequences. The book contains 16 chapters, each of which focuses on a specific theme. They have been edited together to demonstrate why and how, as a key part of a wider and connected approach to public policy, a better transport system will result not just in better journey experiences, but will also improve economic, environmental and social wellbeing. The book draws largely but not exclusively on examples from Great Britain, but has international relevance because the fundamental issues hold true across the developed world, notwithstanding different local contexts.Less

This paper depicts actual situations of policy education at the graduate level in Japan by studying examples of Professional Graduate Public Policy Schools, which have been established in 2003. As of 2014, there are eight such graduate schools in Japan. The points of discussion in this study are (1) concepts and procedures for starting public policy schools, (2) institutional and educational practices in public policy schools, (3) concrete case studies of Tokyo’s first Professional Graduate Public Policy School, and (4) the accreditation system for public policy schools. After the discussion, some characteristics and perspectives of the public policy school system are examined: permission and accreditation as controls to secure education quality, revision of accreditation standards, vocational perspectives of graduates, and cooperation between schools and vocational sectors for education and recruitment.Less

The history of how this has occurred is rarely discussed, unlike other countries in Europe. How Europe shapes British public policy examines the development of the EU as a sectarian issue in the UK. It discusses the effects of disengagement through the political practices of policy making and the implications that this has had for depoliticisation in government and the civil service. It considers the effects of EU membership in shaping key policy areas - trade and privatization, the single market and the environment, and subsidiarity in the development and implementation of devolved and decentralized governance. In the global race for skilled immigrants, governments compete for workers. In pursuing such individuals, governments may incidentally discriminate on gender grounds. Existing gendered differences in the global labour market related to life course trajectories, pay gaps and occupational specialisation are refracted in skilled immigration selection policies. This book analyses the gendered terrain of skilled immigration policies across 12 countries and 37 skilled immigration visas. It argues that while skilled immigration policies are often gendered, this outcome is not inevitable and that governments possess scope in policy design. Further, the book explains the reasons why governments adopt more or less gender aware skilled immigration policies, drawing attention to the engagement of feminist groups and ethnocultural organisations in the policy process. In doing so, it utilises evidence from 128 elite interviews undertaken with representatives of these organisations, as well as government officials, parliamentarians, trade unions and business associations in Australia and Canada over the period 1988 through to 2013. Presenting the first book-length account of the global race for talent from a gender perspective, Gender, migration and the global race for talent will be read by graduate students, researchers, policy-makers and practitioners in the fields of immigration studies, political science, public policy, sociology, gender studies and Australian and Canadian studies.Less

From the middle of the twentieth century, think tanks have played an indelible role in the rise of American conservatism. Positioning themselves against the alleged liberal bias of the media, academia, and the federal bureaucracy, conservative think tanks gained the attention of politicians and the public alike and were instrumental in promulgating conservative ideas. Yet, in spite of their formative influence on media and public opinion, little has been written on the history of these institutions. Right Moves is the first sustained investigation of the rise and historical development of the conservative think tank as a source of political and cultural power in the United States. What we now know as conservative think tanks--research and public relations institutions populated by conservative intellectuals--emerged in the postwar period as places for theorizing and “selling” public policies and ideologies to both lawmakers and the public at large. Right Moves traces the progression of think tanks from their outsider status in a world of New Deal and Great Society liberalism to their current prominence as a counterweight to progressive political institutions and thought in a “marketplace of ideas.” By examining the rise of the conservative think tank, Right Moves makes invaluable contributions to our historical understanding of conservatism, public policy formation, and capitalism.Less

The chapter considers the influences on British public policy making primarily from those influences which are internal and those which are external. The internal influences include political party ideology, electoral cycles and role of internal policy units. There is a longer discussion on the role of the civil service in public policy making. The external influences are grouped into four categories - quasi-informal, opaque informal, formal and quasi-voluntaristic. It does this through a series of analytical lenses including agenda setting, the application of a programmatic approach to government policy, policy persistence and operational style. It also consider the detachment of policy from delivery to create orphan polices and the amplification of EU policy through processes of ‘gold plating’. Finally there is a discussion of the use of ‘blame culture’. The chapter goes on to consider the implications of this shaping including quasi-marketisation of the public sector, constitutional reform, the development of policy institutions and the development of policy culture. In particular there is a discussion about the effects of depoliticisation on policy issues within the UK which are EU in origin. It also covers the UK’s policy dependency on the EU. The final part of this chapter considers the ways in which the provenance of EU policies within the UK can be detected including intertextuality, the role of meta narratives, orphan policies, continuity between political parties, persistence in delivery, absenting the ‘other’, shadow synchronicity, indirect comparison and comparative coincidence.Less

A timely and multifaceted portrait of the lawyers who serve the diverse constituencies of the conservative movement, this book explains what unites and divides lawyers for the three major groups—social conservatives, libertarians, and business advocates—that have coalesced in recent decades behind the Republican Party. Drawing on in-depth interviews with more than seventy lawyers who represent conservative and libertarian non-profit organizations, the book explores their values and identities, and traces the implications of their shared interest in promoting political strategies that give lawyers leading roles. However, beneath the private veneer,the system also relies on a more influential but less visible player forindispensible support– the government. Public programs are of such foundational importance to American health care that they can be credited with creating the systemas it exists today. Private health care entrepreneurship actually representsa massive partnership between the public and private spheres. This book traces the role of seminal public programs in building four keyhealth care sectors into the financial powerhouses they are today - pharmaceuticals, hospitals, the medical profession, and private insurance. It followsthe history of each, recounts statistical trends in their growth, and illustrates with case studies the extensive impact of government policies. Beyond its accomplishments, health care’s public-private collaborationalso has its share of failings. In particular, public largess has spawned private sector behemoths that perennially lobby for regulatory favors and ever greater levels of support. This has helped to make American health care the most expensive in the world. Nevertheless, for better or worse, the government is the only entity with the resources and national perspective needed to create an infrastructure on which the system can rest. As no specific training in policy analysis has developed in Brazil, the chapter discusses instruction in the public policy field and the contribution of postgraduate education to preparing policy analysts. Political and policy analyses first related to subjects dear to Brazil's intelligentsia in the 20th century, when intellectuals and academics from various fields applied themselves basically to studying the State and the patterns of its development. Drawing a distinction between ‘instruction’ and ‘training’, the authors show that instruction forms part of the policy analyst's training, although that training is not restricted to academic instruction, but also incorporates professional practice.Less

This chapter suggests that investment schemes should be redesigned according to a location’s sustainable development objectives and the potential contributions of FDI toward sustainable development. Not only will this help to avoid wasteful or inefficient incentives, the authors argue, but, by promoting sustainable development through incentive programs, governments could improve the viability of important investments (such as in electricity, water supply, health and education services), making those services more accessible and affordable for the poor, and the jurisdiction a more attractive investment destination.Less

This chapter examines Glasgow’s successful 21st century transformation from an industrial city and discusses the insecurities and contradictions that challenge this positive story of regeneration. It highlights why Glasgow makes such a good case study of a post-industrial city, by discussing its recent history using a framing that draws out the city’s ‘epic’ and ‘toxic’ dimensions, during which both the private market and state-led planning failed so spectacularly, leading to a city that was decaying, with more acute economic and environmental problems than any other British city. The chapter then considers the theory of post-industrialism as it was developed in the 1970s and the archetypical characteristics of a post-industrial city, to pose the question: what lies beyond that transitional status?Less
