The controversy surrounding contingent valuation following the Exxon Valdez disaster and the NOAA Panel report suggests the need for improved CV study designs. Three issues are of importance in CV studies: understanding option price, sorting out non‐use values, and the relationship between willingness‐to‐pay (WTP) and willingness‐to‐accept (WTA) compensation. Progress also demands more research on the types of information respondents commonly use when answering CV questions, as well as resolving issues of how to deal with zero, protest, and misstated responses.Less

Contingent valuation has been used officially and unofficially by Federal and State agencies in the USA for a number of decades, although its use accelerated in the early 1980s. The results of CV studies have guided resource regulation and environmental protection, and they have been accepted by Courts in legal cases. Contingent valuation is one of the recognized valuation methods employed in assessments under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (1980).Less

In chapter 4, “Coral Law under Threat,”the pendulum swings back to despair. The chapter documents the focus of contemporary legal regimes—in particular, the U.S. Endangered Species Act—on threat and endangerment, exposing how ill-equipped this law is for dealing with coral species and also with the sheer scale of their “super wicked problem.” Here, federal administrators provide insight into the processes by which listing and delisting decisions take place, their deliberations about coral classification providing a fresh perspective on the correlations between law and science. While the frustrations with existing legal regimes, as well as the fraught relationship between scientists and lawyers, invoke a sense of despair, some also see hope on the legal horizon. Two such hopeful instances are the emerging international regulation of climate change and the signals of possible receptiveness by U.S. courts to the assertion of constitutional rights to a healthy environment.Less

This book has had eight regional chapters, one international chapter, and a synthesis chapter which all contain copious material for U.S. marine fisheries ecosystems. But what does it all mean? The overarching theme of this book is that although much work remains, much progress has occurred. This chapter provides a short synopsis of several major “so-whats” to elucidate the major lessons we have learned and the major issues still facing us regarding progress toward ecosystem-based fisheries management (EBFM). We attempt this synopsis by posing a series of questions, questions which are routinely presented to us, and then attempt to address them. We pose the question of what happens if we don’t do EBFM, and briefly explore some considerations that question raises. We conclude by asking where we will be in 10 years with respect to EBFM? Ten years ago the debate shifted from “what and why” of EBFM to “how” we actually do EBFM. Ten years from now we hope that the EBFM debate will have shifted into “how well have we been doing.”Less
