This study focuses on the historical configuration of territorial borders and functional boundaries of the European nation states, and interprets integration as a process of transcendence, redefinition, and shift of those same boundaries that alters the nature of the nation states’ domestic political structures. The core of the argument concerns the relationship between the institutional design of the new Brussels centre, the boundary redefinitions that result from its political production, and the consequences of both these processes on the established national and emerging European political structures. The EU is interpreted through three key conceptual tools: ‘centre formation’, ‘system building’, and ‘political structuring’. The ‘centre formation’ — with limited administrative and fiscal capabilities and strong regulatory and judicial capabilities — is not accompanied by ‘system building’ in the field of cultural integration, social sharing institutions, and participation rights, that is, by institutions forcing its components to stay within it beyond the mere instrumental calculations. Given that for any new centre a balance must exist between its system building capacity and the scope and reach of its political production, the argument is that the ambitious political production of the EU is clearly out of balance with its weak system building capacity. As far as the ‘political structuring’ is concerned, this work argues that the institutional design of the Union and its weak system building militate to date against any stable form of political structuring for its representative actors, while its growing political production tends to undermine national mechanisms of political representation and legitimation. Under these conditions, any institutional democratization without political structuring may turn into facade electioneering, at best, or dangerous experiments, at worst. In the view of classical sociology — that takes the existence of a certain overlap between social identities, political boundaries, and social practices as a precondition for establishing political agency and a ‘rational’ political order — the EU is both a source of problems but also a possible solution to them. It can be seen as a project for regaining some degree of coherence between extended social practices, social identities, solidarity ties, and rules of deliberation at the European level. Most of the ideas expressed in this book show how problematic this project is believed to be.Less

Clinical data-mining (CDM) involves the conceptualization, extraction, analysis, and interpretation of available clinical data for practice knowledge-building, clinical decision-making, and practitioner reflection. Depending upon the type of data mined, CDM can be qualitative or quantitative; it is generally retrospective, but may be meaningfully combined with original data collection. Any research method that relies on the contents of case records or information systems data inevitably has limitations, but with proper safeguards these can be minimized. Among CDM's strengths however, are that it is unobtrusive, inexpensive, presents little risk to research subjects, and is ethically compatible with practitioner value commitments. When conducted by practitioners, CDM yields conceptual as well as data-driven insight into their own practice- and program-generated questions. This book covers all the basics of conducting practitioner-initiated CDM studies or CDM doctoral dissertations, drawing extensively on published CDM studies and completed CDM dissertations from multiple social work settings in the United States, Australia, Israel, Hong Kong, and the United Kingdom. In addition, it describes consulting principles to help with forging collaborative university-agency CDM partnerships.Less

Little raises many questions of international legality in addressing the finer concepts of peace enforcing, peacekeeping, peacemaking, and peace building. He accentuates the rule of law, democracy, and human rights as foundations for each of these stages towards a Just Peace. Looking towards collectively accepted international treaties for a concept of justice, Little taps into a notion of legal validity that is at least partially composed of a legitimacy that emanates from the people themselves. Although there are valid reasons for questioning who has been allowed to participate in the process developing international law, protecting the human rights of all, and labelling it justice certainly does not seem to create an untenable starting point. In fact, this approach that looks to protect the rights of all can be quite constructive because, ultimately, it is the people involved in a conflict who will determine whether a peace is just, and therefore lasting.Less

Allocating reparation benefits to victims of civil rights abuses with a lasting effect on their well-being is a tremendous challenge. By converting benefit payments into shares and beneficiaries into shareholders of microfinance institutions (MFIs), the former victims become active partners of aid and owners of local institutions. In many countries, indigenous savings and credit associations are the only civil society institutions which have survived the breakdown of society, representing the social capital for the reconstruction of local financial institutions. In other countries, such institutions have to be newly built. In either case, experienced international NGOs may be instrumental in building or reconstructing MFIs owned by recipients of reparation payments. Part of the funding in a reparation program may thus be allocated directly to the victims-turned-shareholders, the other part to institution-building. Based on satisfactory performance of the MFI, the share capital may be augmented by donor grants and bank borrowings to increase the volume of loans to the user-owners for income-generating activities. In terms of sustainable impact, there is no alternative to institution-building.Less

This book studies the relationship between function and aesthetic value, breaking with the philosophical tradition of seeing the two as separate. It begins by developing and defending, in a general way, the concept of Functional Beauty, exploring how the role of function in aesthetic appreciation has been treated by some notable thinkers in the history of aesthetics. It then considers the relationship to Functional Beauty of certain views in current aesthetic thought, especially what is called ‘cognitively rich’ approaches to the aesthetic appreciation of both art and nature. Turning to work on the nature of function in the philosophy of science, it argues that this line of enquiry can help solve certain philosophical problems that have been raised for the idea that knowledge of function plays an important role in aesthetic appreciation. Although philosophical discussions of aesthetic appreciation tend to focus largely and sometimes almost exclusively on artworks, the range of aesthetic appreciation is, of course, much larger. Not simply art, but also nature, architecture, and even more mundane, everyday things — cars, tools, clothing, furniture, and sports — are objects of frequent and enthusiastic aesthetic appreciation. Accordingly, the second half of the book considers the place and importance of Functional Beauty in the aesthetic appreciation of a broad range of different kinds of things. The final chapters explore Functional Beauty in nature and the natural environment, in architecture and the built environment, in everyday artefacts, events, and activities, and finally in art and the artworld. In each case, the book argues that Functional Beauty illuminates our aesthetic experiences and helps to address various theoretical issues raised by these different objects of appreciation.Less

This book studies modern Alsatian history using gender as a category of historical analysis, and the first to record the experiences of the region's women from 1870 to 1946. Relying on an extensive array of documentary, visual and literary material, national and regional publications, oral testimonies, and previously-unused archival sources gathered in France, Germany and Britain, the book contributes to the growing literature on the relationship between gender, the nation and citizenship, and between nationalism and feminism. It does so by focusing on the roles, both passive and active, that women played in the process of German and French nation-building in Alsace. The work also critiques and corrects the long-held assumptions that Alsatian women were the preservers, after 1871, of a French national heritage in the region, and that women were neglected or disregarded by policy-makers concerned with the consolidation of German, and later French, loyalties. Women were in fact seen as important agents of nation-formation and treated as such. In addition, all the categories of social action implicated in the nation-building process — confession, education, socialization, the public sphere, the domestic setting, the iconography of regional and national belonging — were themselves gendered. Thus nation-building projects impacted asymmetrically on men and women, with far-reaching consequences. Having been ‘nationalized’ through different ‘rounds of restructuring’ than men, the women of Alsace were, and continue to be excluded from national and regional histories, as well as from public memory and official commemoration. Peace operations are the UN's flagship activity. Over the past decade, UN blue helmets have been dispatched to evermore challenging environments from the Congo to Timor to perform an expanding set of tasks. From protecting civilians in the midst of violent conflict to rebuilding state institutions after war, a new range of tasks has transformed the business of the blue helmets into an inherently knowledge-based venture. But all too often, the UN blue helmets, policemen, and other civilian officials have been ‘flying blind’ in their efforts to stabilize countries ravaged by war. The UN realized the need to put knowledge, guidance and doctrine, and reflection on failures and successes at the center of the institution. Building on an innovative multidisciplinary framework, this study provides a first comprehensive account of learning in peacekeeping. Covering the crucial past decade of expansion in peace operations, it zooms into a dozen cases of attempted learning across four crucial domains: police assistance, judicial reform, reintegration of former combatants, and mission integration. Throughout the different cases, the study analyzes the role of key variables as enablers and stumbling blocks for learning: bureaucratic politics, the learning infrastructure, leadership, as well as power and interests of member states. Building on five years of research and access to key documents and decision-makers, the book presents a vivid portrait of an international bureaucracy struggling to turn itself into a learning organization.Less

Society has instigated diverse responses in an attempt to end domestic violence in intimate relationships, which has plagued our society and deeply hurt our families and children. Helping professionals are constantly in search of effective ways to provide treatment for domestic violence offenders, although such a search is haunted by hope, promises, and controversies. This book describes and evaluates a solution-focused group treatment program for domestic violence offenders. This is a goal directed, solution-based, group treatment program that utilizes goals to create a context for participants to identify, notice, rediscover, and reconnect with their strengths and resources in addressing problems with domestic violence. Building on a strengths perspective, a solution-focused approach holds a person accountable for solutions instead of focusing on problems. Without minimizing or denying the destructiveness of violent behaviors, such an approach aims at empowering a person so that she or he can discover and/or reconnect with his or her strengths and resources to build a more satisfying life that excludes violence in intimate relationships. Such a treatment approach uses the language and symbols of “solution and strengths” as opposed to the language of “deficits and blame.” Treatment focuses on identifying exception and solution behaviors that are then amplified, supported, and reinforced through a solution-building process. This book describes a pragmatic, step-by-step, “how-to” description of what helping professionals can do in treatment to create positive changes in domestic violence offenders. This is a treatment guide from intake to termination, capitalizing on participants' strengths and goal accomplishment to encourage and assist their efforts to eliminate and exclude violence from intimate relationships.Less

Transitional administrations represent the most complex operations attempted by the United Nations. The missions in Kosovo (1999—) and East Timor (1999–2002) are commonly seen as unique in the history of the United Nations. But they may also be seen as the latest in a series of operations that have involved the United Nations in ‘state‐building’ activities, in which it has attempted to develop the institutions of government by assuming some or all of those sovereign powers on a temporary basis. Viewed in light of earlier UN operations, such as those in Namibia (1989–1990), Cambodia (1992–1993), and Eastern Slavonia (1996–1998), the idea that these exceptional circumstances may not recur is somewhat disingenuous. The need for policy research in this area was brought into sharp focus by the weighty but vague responsibilities assigned to the United Nations in Afghanistan (2002—) and its contested role in Iraq (2003—).This book seeks to fill that gap. Aimed at policy‐makers, diplomats, and a wide academic audience (including international relations, political science, international law, war studies, and development studies), the book provides a concise history of transitional administration and a treatment of the five key issues confronting such operations: peace and security, the role of the United Nations as government, establishing the rule of law, economic reconstruction, and exit strategies. Transitional administrations represent the most complex operations attempted by the United Nations. The missions in Kosovo (1999—) and East Timor (1999–2002) are commonly seen as unique in the history of the United Nations. But they may also be seen as the latest in a series of operations that have involved the United Nations in ‘state‐building’ activities, in which it has attempted to develop the institutions of government by assuming some or all of those sovereign powers on a temporary basis. Viewed in light of earlier UN operations, such as those in Namibia (1989–1990), Cambodia (1992–1993), and Eastern Slavonia (1996–1998), the idea that these exceptional circumstances may not recur is somewhat disingenuous. The need for policy research in this area was brought into sharp focus by the weighty but vague responsibilities assigned to the United Nations in Afghanistan (2002—) and its contested role in Iraq (2003—).
This book seeks to fill that gap. This chapter reconstructs the European and American patterns of state, nation, and democracy building to show the different authority structures that emerged in the 19th century — and thus the institutionalization of different modalities of partisan politics in the 20th century. The different processes of political development in Europe and America has brought into being two distinct political orders on the two shores of the Atlantic. In the European nation-states the political order was constructed around the experience and the idea of the state. In both early state-builders and late state-builders, the state has become the natural container of the nation. In America, on the other hand, nationality has been the product of the democratic process, not its precondition. Nation and democracy went together, the one defining the other. It was the democratic process which defined the boundaries of the nation.Less

Writing about the glories of late-medieval architecture, Wim Swaan saw the problem as summed up by Johan Huizinga's remark that medieval life ‘bore the mixed smell of blood and roses’. Perhaps the main contribution to knowledge to be made by studying castles and fortresses in proper breadth is to shed some light on the aspirations and adversities of noblemen and ladies, ecclesiastics, townspeople, and of the great rural majority, and on their civilized achievements, institutional as well as architectural, in the western European middle ages.Less

Why have national governments of EU member states created and, over the past fifty years, successively endowed the European Parliament with supervisory, budgetary, and legislative powers? This book presents a three-staged argument to explain how the European Parliament acquired this power ‘trias’. First, it is argued that the construction of a supranational polity induces political elites in the member states to reflect on the implications posed by transfers of national sovereignty for domestic processes of democratic accountability and interest representation. It is shown empirically that there exists a strong correlation between national governments’ decisions to transfer sovereignty and political elites’ perception of a ‘democratic legitimacy deficit’ that triggers a search for institutional solutions for its remedy. In a second step, it is argued that political elites, first and foremost, domestic political parties, advance different proposals to alleviate the perceived ‘legitimacy deficit’. These proposals are derived from ‘legitimating beliefs’ that vary cross-nationally and across political parties. Consequently, the creation and empowerment of a supranational parliamentary institution plays a prominent but not exclusive role as potential remedy to the ‘democratic legitimacy deficit’. Third, the book illuminates the mechanisms through which ‘legitimating beliefs’ expressed by political elites and the behaviour of national governments who negotiate and decide on the creation and potential empowerment of the European Parliament are linked. What logic of action best captures national governments’ decisions to empower the European Parliament? The explanatory power of the theoretical argument will be explored by looking at three landmark cases in the European Parliament’s history: its creation as ‘Common Assembly’ of the ECSC Treaty and the concomitant acquisition of supervisory powers vis-à-vis the High Authority, the acquisition of budgetary powers (Treaty of Luxembourg of 1970) and of legislative powers (Single European Act signed in 1986). The developments ranging from the Maastricht Treaty to the adoption of the Treaty establishing a Constitution for Europe will also be analysed in the light of the theory.Less

Since the mid-1990s, the United Nations and other multilateral organizations have been entrusted with exceptional authority for the administration of war-torn and strife-ridden territories. In Bosnia and Herzegovina, Eastern Slavonia, Kosovo, and East Timor, these organizations have assumed responsibility for governance to a degree unprecedented in recent history. These initiatives represent some of the boldest experiments in the management and settlement of intra-state conflict ever attempted by third parties. This book is a study of recent experiences in the international administration of war-torn territories. Examines the nature of these operations—their mandates, structures, and powers—and distinguishes them from kindred historical and contemporary experiences of peacekeeping, trusteeship, and military occupation. Analyses and assesses the effectiveness of international administrations and discusses, in thematic fashion, the key operational and political challenges that arise in the context of these experiences. Also reflects on the policy implications of these experiences, recommending reforms or new approaches to the challenge posed by localized anarchy in a global context. Argues that despite many of the problems arising from both the design and implementation of international administrations—some of them very serious—international administrations have generally made a positive contribution to the mitigation of conflict in the territories where they have been established.Less

It outlines the land battles between expansionist urban governments at the municipal and district levels and rural governments at the county and township levels. The struggle between urban and rural governments is set in the historical shift in which industrialism has largely given way to urbanism since the late 1990s. Drawing on the changing political discourse, urban governments have moved to incorporate scattered industrial estates formerly controlled by rural governments. As a result, the urban fringe becomes a primary site of capital accumulation, territorial expansion, and consolidation vital to urban governments' local state‐building projects. The urban government's logic of property‐based accumulation and territorial expansion builds on itself and finds expression in massive‐scale mega projects like “new cities” and “university cities” built on former village land in the outskirts of the city.Less

This first chapter sketches the elements of a theory of voice structuring under different conditions of territorial confinement of actors and resources. Using Hirschman and Rokkan’s work, the chapter formulates theoretical propositions about how processes of internal conflict generation and opposition development (political structuring) relate to the processes of boundary demarcation in a large-scale territorial polity, and how the two relate to the internal institutional hierarchy of the same territory. A correspondence is established between micro-individual choices of exit and the corresponding systemic processes of boundary building and control; the micro-individual loyalty and the systemic structures and processes of system maintenance; and the micro-individual propensity to voice and the systemic structuring of channels and organizations for representation. It is argued that the framework is general enough to be applied to different territorial political formations, to characterize pre-nation-state polities, as well as to understand post-nation-state polities.Less

This chapter provides a more detailed sectoral account of how the adjudication of one class of trading disputes gradually, but authoritatively, undermined the intergovernmental aspects of the EC, while enhancing the polity's supranational, or federal, character. Assesses the impact of adjudicating the freer movement of goods provisions of the Treaty of Rome on integration and supranational governance, focusing on the problem of non‐tariff barriers, as governed by Arts. 28–30 (EC). Proceeds as follows: first, the treaty rules on intra‐EC trade are examined, hypotheses derived about how the domain could be expected to evolve, and the argument advanced is contrasted with alternatives; second, in a section ‘Judicial Governance and Market‐Building’, the emergence is tracked of the basic doctrinal framework (the Dassonville framework) governing the domain, an analysis made of the aggregate data on adjudication in the sector, and the impact traced of the European Court of Justice's case law on the decision‐making of other actors, including the European Commission and Member State governments; third, the mutation of the framework that occurred in the 1990s is discussed – an event that was heavily conditioned by the endogenous development of the law itself; the chapter concludes with an assessment of the findings in light of the pertinent scholarly debates about the impact of the European legal system on the greater course of market‐building and political integration.Less
